By creating an account or using Smitpet, you agree to these Terms and Conditions. If you do not agree, you must not access or use the Service.

2. Company Information

Smitpet is operated by Smitpet LLC, located at 1500 NW 89TH CT, Suite 119, Doral, FL 33172, Miami, Florida, United States.

3. Eligibility

You must be at least 18 years old to use Smitpet. By using the Service, you represent and warrant that you meet this requirement.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to keep it updated.

5. Pet Profiles and Content

You are solely responsible for all content you upload, including pet profiles, photos, and descriptions. You must have the necessary rights to use such content and ensure it does not violate any laws or third-party rights.

You retain ownership of the content you upload. By uploading content to Smitpet, you grant Smitpet LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and make that content available as necessary to operate and provide the Service. This license ends when the content is deleted from the Service, except where retention is required by law or reasonably necessary for legal or security purposes.

6. Acceptable Use

You agree not to:
(a) use the Service for unlawful purposes;
(b) harass, abuse, or harm other users;
(c) upload false, misleading, inappropriate, abusive, exploitative, or infringing content;
(d) impersonate any person or entity;
(e) attempt unauthorized access to the Service;
(f) use the Service for commercial purposes without authorization.

7. Matches and User Interactions

Smitpet provides a platform to discover and connect pet profiles. We do not verify users and make no guarantees regarding user identity, behavior, compatibility, responses, or outcomes. You are solely responsible for your interactions with other users.

8. Blocking and Moderation

We reserve the right to monitor content and user activity and to remove content, restrict visibility, block users, suspend access, or terminate accounts at our sole discretion to maintain a safe and respectful community.

9. Child Safety Standards

Smitpet has zero tolerance for child sexual abuse and exploitation (CSAE) and child sexual abuse material (CSAM). Users must not upload, share, distribute, request, promote, facilitate, or otherwise engage with content or conduct involving the sexual abuse or exploitation of children. Any such activity is strictly prohibited on Smitpet. Users can report inappropriate content, behavior, or child safety concerns through the "Report a Safety Concern" option available in the Help & Support section of the Smitpet app, or by contacting support@smitpet.com. Smitpet reviews reported safety concerns and may remove content, restrict access, suspend or terminate accounts, and take other appropriate action when violations are identified. When Smitpet becomes aware of confirmed child sexual abuse material or other conduct requiring reporting under applicable law, Smitpet will report it to the appropriate regional or national authorities, including the National Center for Missing & Exploited Children (NCMEC) when applicable, and will cooperate with lawful investigations. For child safety concerns or questions regarding Smitpet's child safety practices, contact our designated safety point of contact at support@smitpet.com.

10. Premium Features and Subscriptions

Certain features may require a paid subscription. Payments are processed through third-party platforms such as Apple App Store or Google Play Store. Those platforms are solely responsible for billing, subscription management, cancellations, and refunds under their respective policies. Smitpet LLC does not process payments directly and is not responsible for payment-related issues handled by these platforms.

11. Account Suspension or Termination

We may suspend or terminate your account if you violate these Terms, engage in harmful behavior, provide false information, or pose a risk to other users or the Service.

12. Intellectual Property

All content, features, design, branding, and software of Smitpet are owned by or licensed to Smitpet LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reproduce, or exploit any part of the Service without permission.

13. Disclaimers

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, error-free operation, availability at all times, or that the Service will meet your expectations.

14. Limitation of Liability

To the fullest extent permitted by law, Smitpet LLC shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of data, use, profits, or goodwill arising from or related to your use of the Service.

15. Indemnification

You agree to defend, indemnify, and hold harmless Smitpet LLC, its affiliates, officers, and representatives from any claims, damages, liabilities, losses, and expenses arising from your use of the Service or violation of these Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

17. International Use

If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws. Your data may be processed in the United States.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
